At Evolve Your Bod, we believe you deserve transparent, respectful, and patient-centered care. This Patient Bill of Rights outlines the rights you have when receiving healthcare services coordinated through our platform, regardless of your care model. These rights apply to all Evolve patients across Telehealth (TH), In-Person Visit (IPV), Hybrid Consult + IV Therapy (Hybrid), and Mobile IV Therapy (Mobile IV) services.
These rights are grounded in applicable federal and state law, including the Texas Medical Practice Act, the Texas Medical Records Privacy Act, HIPAA, and recognized standards of patient care.
1. Your General Rights as a Patient
Regardless of the care model through which you receive services, you have the right to:
✓ Receive respectful, courteous, and dignified care. You will be treated with consideration and respect at all times, without discrimination based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, age, disability, or ability to pay.
✓ Be informed of the identity and qualifications of your healthcare provider. Before care begins, you have the right to know the name, licensure status, and professional role of the provider or clinical staff member delivering your care.
✓ Receive clear, understandable information about your diagnosis, treatment options, and prognosis. Your provider should explain your condition and the proposed treatment in language you can understand, including the expected benefits, material risks, and alternatives.
✓ Make informed decisions about your care. You have the right to participate in decisions about your treatment and to give or withhold informed consent before any procedure, medication, or therapy begins.
✓ Refuse treatment. You have the right to refuse any proposed treatment, medication, or procedure at any time. Your provider will explain the potential consequences of refusal, but the decision is yours.
✓ Privacy and confidentiality of your health information. Your Protected Health Information (PHI) will be handled in accordance with HIPAA, the Texas Medical Records Privacy Act, and our Notice of Privacy Practices. Your information will only be used and disclosed as described in those documents and your signed PHI / Data-Sharing Authorization.
✓ Access your medical records. You have the right to inspect, obtain copies of, and request amendments to your medical and billing records as provided by HIPAA and applicable state law.
✓ Receive a copy of your Notice of Privacy Practices. You may request a paper or electronic copy at any time at evolveyourbod.com/notice-of-privacy-practices.
✓ File a complaint without fear of retaliation. If you believe your rights have been violated, you may file a complaint with Evolve Your Bod, the rendering provider or partner clinic, the Texas Medical Board, the U.S. Department of Health and Human Services, or the Texas Attorney General. We will not retaliate against you for filing a complaint.
✓ Receive care in a safe environment. Whether your care occurs through telehealth, at a partner clinic, at a satellite location, or at a mobile IV service location, you have the right to a care environment that meets applicable safety standards.
✓ Be informed of the costs of your care. You have the right to receive information about the anticipated cost of your treatment, including whether insurance applies and what your estimated financial responsibility will be, before services are rendered whenever possible.
✓ Continuity of care. If your care is transferred from one provider to another, or if your treatment plan changes, you have the right to be informed and to have your care transitioned in an orderly manner.
2. Your Right to Know Who Is Treating You
Evolve Your Bod operates as a Management Services Organization (MSO) and care coordination platform. Evolve does not practice medicine. Your clinical care is delivered by independent, licensed healthcare providers affiliated with medical groups and partner clinics.
You have the right to know, before care begins:
✓ The name of the entity providing your medical care (the rendering Medical Group or partner clinic).
✓ The name and credentials of the individual provider treating you (physician, nurse practitioner, physician assistant, or other licensed professional).
✓ The role of Evolve Your Bod as the technology and care coordination platform, and that Evolve is not the medical provider.
✓ In Hybrid encounters: that the on-site nurse is a facilitator operating under physician direction, and that the remote physician is the treating clinician.
✓ In Mobile IV encounters: the identity of the ordering physician and the licensed nurse who will administer your IV therapy.
3. Your Rights in Telehealth Encounters
When receiving care through the Telehealth (TH) care model, you additionally have the right to:
✓ Be informed of the specific risks and limitations of telehealth, as described in the Telehealth Informed Consent.
✓ Receive telehealth services from a provider who is licensed in the state where you are physically located at the time of the consultation.
✓ Decline telehealth and request an in-person consultation if you believe your condition requires a physical examination.
✓ A private, secure, HIPAA-compliant telehealth platform for your consultation.
✓ Know whether others (tech support, translators, clinical staff) are present during your session, and to be informed of their roles.
✓ Withdraw consent to telehealth services at any time.
4. Your Rights in In-Person Visit Encounters
When receiving care at a partner clinic through the In-Person Visit (IPV) care model, you additionally have the right to:
✓ Know the name and location of the partner clinic where your visit will take place before your appointment.
✓ Know that the partner clinic, not Evolve, is the rendering provider for your clinical encounter.
✓ Receive and review any clinic-specific consent forms required by the partner clinic before treatment begins.
✓ Know whether your visit is covered by insurance and what your estimated financial responsibility will be.
✓ A clean, safe, and professionally maintained clinical environment.
5. Your Rights in Hybrid Encounters
When receiving care through the Hybrid (Consult + IV) care model, which involves a three-party arrangement, you additionally have the right to:
✓ Be fully informed of the three-party care arrangement (Evolve as platform, satellite site staff as facilitator, rendering Medical Group and remote physician as treating clinician) before your visit, as described in the Hybrid Satellite-Site Facilitation Disclosure.
✓ Know that you are presenting at a satellite or facilitating location, not at the Medical Group’s primary office.
✓ Know that the on-site nurse does not independently diagnose, prescribe, or make treatment decisions.
✓ Know the identity of the remote physician who will conduct your telehealth consultation and make clinical decisions.
✓ Understand how your information flows between Evolve, the satellite site, and the rendering Medical Group.
✓ Refuse IV therapy or any component of the hybrid encounter at any time.
6. Your Rights in Mobile IV Encounters
When receiving care through the Mobile IV care model, you additionally have the right to:
✓ Know the identity of the ordering physician and the licensed nurse who will administer your IV therapy.
✓ Have the mobile nurse verify your identity, review your allergies and medications, and explain the IV formulation before administration begins.
✓ Have the mobile nurse assess your service location for safety and suitability before beginning the procedure.
✓ Know the emergency escalation protocols in place, including that 911 will be called if a serious adverse reaction occurs.
✓ Refuse or discontinue IV therapy at any time.
✓ Be informed of any state licensure requirements applicable to mobile IV services (including Texas HCSSA/home-infusion regulations).
7. Your Rights When Receiving IV Therapy (Any Care Model)
When receiving IV therapy through any care model (Hybrid or Mobile IV), you have the right to:
✓ Know who ordered your IV therapy (the prescribing physician) and who is administering it (the licensed nurse).
✓ Be informed of the specific IV formulation, ingredients, and dosage before administration.
✓ Be informed that IV formulations may include compounded preparations that are not FDA-approved.
✓ Be informed of the risks and potential complications of IV therapy, as described in the IV Therapy Treatment Consent and the Important Safety Information page.
✓ Have the administering nurse monitor you during and after the infusion for adverse reactions.
✓ Know that emergency escalation protocols are in place and that the nurse will discontinue the infusion and intervene if you experience an adverse reaction.
✓ Refuse or discontinue IV therapy at any time, for any reason.
8. Your Rights Regarding Payment and Billing
You have the right to:
✓ Be informed of the anticipated cost of your treatment before services are rendered, whenever possible.
✓ Know whether your service is cash-pay (Telehealth) or potentially covered by insurance (IPV, Hybrid, Mobile IV).
✓ Know who is billing you and for what services: Evolve (platform/coordination fees), the partner clinic or Medical Group (clinical services), or the pharmacy (medications).
✓ Receive an itemized statement of charges upon request.
✓ Understand the cancellation and refund policy before enrolling in services, as described in the Returns and Refunds section of our Terms of Service.
✓ Not be denied emergency care based on ability to pay (this applies to emergency medical services under EMTALA, not to elective services offered through Evolve).
9. Weight-Loss Consumer Bill of Rights
If you are enrolled in a medical weight management program through Evolve Your Bod, the following additional consumer protections apply. These are consistent with the principles established by state weight-loss consumer protection statutes:
WARNING: RAPID WEIGHT LOSS MAY CAUSE SERIOUS HEALTH PROBLEMS. RAPID WEIGHT LOSS IS WEIGHT LOSS OF MORE THAN 1½ TO 2 POUNDS PER WEEK OR WEIGHT LOSS OF MORE THAN 1 PERCENT OF BODY WEIGHT PER WEEK AFTER THE SECOND WEEK OF PARTICIPATION IN A WEIGHT-LOSS PROGRAM.
CONSULT YOUR PERSONAL PHYSICIAN BEFORE STARTING ANY WEIGHT-LOSS PROGRAM.
ONLY PERMANENT LIFESTYLE CHANGES, SUCH AS MAKING HEALTHFUL FOOD CHOICES AND INCREASING PHYSICAL ACTIVITY, PROMOTE LONG-TERM WEIGHT LOSS.
QUALIFICATIONS OF THE PROVIDERS IN THIS PROGRAM ARE AVAILABLE UPON REQUEST.
As a weight-loss program participant, you have the right to:
✓ Ask questions about the potential health risks of the program and its nutritional content, psychological support, and educational components.
✓ Receive an itemized statement of the actual or estimated price of the weight-loss program, including extra products, services, supplements, examinations, and laboratory tests.
✓ Know the actual or estimated duration of the program.
✓ Know the name, credentials, and qualifications of the healthcare providers overseeing your weight-loss program.
✓ Understand that individual results vary and that Evolve Your Bod does not guarantee specific weight-loss outcomes.
✓ Discontinue the program at any time, subject to the cancellation and refund terms in the Terms of Service.
10. How to File a Complaint
If you believe your rights as a patient have been violated, you have several options for filing a complaint. You will not be retaliated against for exercising any of these options.

11. State-Specific Patient Rights and Disclosures
Certain states have specific patient rights statutes, consumer protection requirements, or mandatory disclosures that apply in addition to the general rights described above. As Evolve Your Bod expands its services into additional states, state-specific disclosures will be added to this section. If you do not see your state listed below, the general patient rights in Sections 1–9 of this document apply to you.
Texas
Texas Medical Practice Act and Patient Rights
Under the Texas Medical Practice Act (Texas Occupations Code Title 3, Subtitle B) and rules adopted by the Texas Medical Board, patients receiving medical care in Texas have the following rights in addition to those described above:
✓ The right to be treated by a physician or other licensed healthcare professional who meets Texas licensure requirements and practices within their scope of licensure.
✓ The right to have telemedicine and telehealth services delivered in compliance with Texas Occupations Code Chapter 111 (Telemedicine, Teledentistry, and Telehealth), including the requirement that the provider be licensed in Texas or hold an appropriate telemedicine license.
✓ The right to confidentiality of medical records under the Texas Medical Records Privacy Act (Health & Safety Code Chapter 181). Your health information may not be disclosed except as authorized by you or as permitted by law.
✓ The right to file a complaint with the Texas Medical Board regarding a physician, physician assistant, acupuncturist, or surgical assistant. ✓ The right to access your medical records. Under Texas law, a healthcare provider must make your records available to you within 15 business days of your written request.
✓ The right to be informed about the provider’s policies regarding after-hours and emergency coverage.
✓ The right to be notified if your care involves the participation of students, residents, or trainees, and to refuse their involvement in your care.
Texas Weight Management Disclosures
Texas does not have a standalone “Weight-Loss Consumer Bill of Rights” statute identical to those in some other states. However, providers offering weight management services in Texas are subject to the general consumer protection provisions of the Texas Deceptive Trade Practices Act (Business & Commerce Code Chapter 17) and the advertising and marketing standards enforced by the Texas Medical Board. The weight-loss consumer rights described in Section 9 of this document reflect industry best practices and are consistent with the consumer protection principles applicable in Texas.
Texas Telehealth-Specific Rights
Under Texas law (Occupations Code Chapter 111), patients receiving telemedicine services have the right to be treated by a provider who holds a valid Texas medical license or an appropriate telemedicine license, to have their telehealth encounter conducted on a secure platform that meets applicable privacy and security standards, and to have the confidentiality of their health information maintained when telemedicine is provided or facilitated. Texas law permits telemedicine relationships to be established remotely without a prior in-person visit.
Additional States
As Evolve Your Bod expands into additional states, state-specific patient rights disclosures will be added to this section. States with known weight-loss consumer protection statutes, telehealth-specific patient rights, or other mandatory disclosures that may require addition include, but are not limited to: Florida (Sec. 501.0575 Weight-Loss Consumer Bill of Rights), New York (patient rights under Public Health Law), California (Confidentiality of Medical Information Act and CCPA/CPRA), and other states as applicable.
